Can we use xerox/print copy of costly books in library

Dear Library Science Professionals,

Please post your valuable suggestions regarding e books, hand books, any other costly books can we make and use the xerox/print copy in library.

Is this correct or not.

Please give suggestions.

sir, photocopying of books and journals will make copyright violation. Try to get original version of the book.

What ever may be the xerox materials can keep for our user reference.  but it should not includ our stack. the xerox materials are not appreciated by any committee.

My reply is NO.

A few months ago, some publishers filed a case against a renowned Central University and the Honble high Court gave the verdict in favour of the publishers concerned.I believe that many of the forum members know the name of the publishers and the University so i abstained from mentioning it in this forum

However, In case you are in desperate need, get the relevant chapter(s) photocopied for teaching purpose only. This is somewhat acceptable in our country. While in USA, if it is beyond the proverbial Fair Use  you have to pay in advance the requisite amount to the Copyright Clearance Centre so that no one can sue you for infringement of copyright act.

I would like to raise a supplementary question on this.

Does fair use allow Xerox Copies in case the original is out of print? If yes then how many copies in a library are permissible?

Photocopy means not violation of copyright. It has some demerits like original document lost it value when it get reprinted by photocopy method, and chances of damaged is increased of documents.

Photocopying of material can not checked easily it but it can be reduced by publishing student edition of books, because student can't afford the high prices of books.

Being a library professional I can request to student not to take the photocopy of documents because it is not good practice and to Publishers and Printers you cooperate with bringing student editions of documents...

Pardon me, I differ to your opinion (or exactly speaking, the first paragraph of your post).

Because Photocopying without any legal permission( and any type of unauthorized copying in any form) is violation of Copyright law. Because the original holder of the copyright (Publisher/Author) loses revenue. If you can not photocopy a particular book you have to purchase it. The publisher gets a portion of the price and the author gets royalty. Through unauthorized Photocopying one is depriving both. This is contravention to intellectual property act and is an offense. It is applicable to UNAUTHORIZED COPYING of any form may it be books or printed/PATENTED  materials, audios like music and/or videos like cinema/dance performance etc.etc.

However, I fully agree to your comments in the successive two paragraphs.

It is my great pleasure that I am in contact to the peoples like you.

But Sir I have mentioned the word ‘Value’ there in my comment, which includes the phenomenon of Cost and Revenue, and Sir I have not mentioned anywhere that you take photocopy of whole chapters either take any specific chapter.

 

Sir I have mentioned some demerits of photocopy that includes all those things which is not good for the copyright issues and existence of document.

 

Photocopy of materials in not good for publishers which is direct related in terms of profit making only, but for the author point of view it may not good in terms of money but author gets its goal of passing the message to readers, which is ultimate goal of a author of contents that is more big profit than money earning by selling the books.

 

 

Sorry Sir …but one thing you have mentioned there in your comment that is ‘Photocopy can be taken for teaching purpose only’. But sir teacher is our “MARGDARSHAK” so this practice will not give a good message to students in the matters photocopy.

Thanks for your post. In my earlier post I have categorically mentioned that the difference is only for the first paragraph; and that I completely agree with the remaining contents.

By the way teaching purpose is in no way related to teachers only. It is essentially academic purpose.To conduct advanced courses and that too,  mostly on NON-TRADITIONAL subjects, some indigenous teaching modules are prepared by the concerned group of teachers/ syllabus committee. The modules are often comprised of articles in journals, chapters/portions of books, reports, illustrations, charts/ diagrams/ tables/data (as the case may be), published in various AUTHORIZED sources. All these materials are clubbed together to develop the modules. Such materials are completely academic in nature and usually do not have any commercial values as such. They are exclusively used for the PURPOSE OF TEACHING only. My point was: in order to develop such teaching aids making photocopies of pertinent literature may be acceptable  because they are prepared for Teaching Purposes only. That's all.
