judgement is favorable to students. UGC is appeal to supreme court. the supreme court judgement is favorable to student. but the judgement copy can't get form the web. but u will see the details in net at indiaeducationreview.com

Can u get me a copy of the Bharathiar university, SET 2012, moderation committee report. Also if u can give me the Writ Petition number of the case filed against SET 2012 result , in Madurai High Court Bench.....Pls I want only 'Bharathiar University SET 2012 Moderation Committee Report'

மதுரை :பல்கலை விரிவுரையாளர்கள் நியமனத்திற்கான 'செட்' தேர்வில், யு.ஜி.சி., முதலில் அறிவித்தபடி குறைந்தபட்ச மதிப்பெண் பெற்றவர்களை தேர்ச்சியடைந்தவர்களாக அறிவித்து, சான்றிதழ்களை வழங்க வேண்டும் என தனி நீதிபதி உத்தரவிட்டதை எதிர்த்து, பாரதியார் பல்கலை தாக்கல் செய்த மேல்முறையீட்டு மனுவை மதுரை ஐகோர்ட் கிளை தள்ளுபடி செய்தது.திருச்சி சரஸ்வதி உட்பட சிலர் தாக்கல் செய்த மனுக்கள்:பல்கலை, கல்லூரி விரிவுரையாளர்கள் நியமனத்திற்கு தேசிய தகுதித் தேர்வு (நெட்) நடத்த, பல்கலை மானியக்குழு (யு.ஜி.சி.,) 2012 ஜூன் 4 ல் அறிவிப்பு வெளியிட்டது. அதிகபட்சமாக முதல் இரண்டு தாள்களில் தலா 100 மதிப்பெண், மூன்றாவது தாளில் 150 மதிப்பெண் பெற வேண்டும் நிர்ணயித்திருந்தனர்.
தேர்ச்சிபெற குறைந்தபட்சம் பொதுப்பிரிவினர் முதல் இரண்டு தாள்களில் தலா 40 சதவீதம், மூன்றாவது தாளில் 50 சதவீதம்; இதர பிற்பட்டோர் (கிரிமீலேயர் அல்லாதவர்கள்) முதல் இரண்டு தாள்களில் தலா 35, மூன்றாம் தாளில் 45 சதவீதம்; ஆதிதிராவிடர், பழங்குடியினர் முதல் இரண்டு தாள்களில் தலா 35, மூன்றாம் தாளில் 40 சதவீதம் மதிப்பெண் பெற வேண்டும் என முதலில் யு.ஜி.சி., உத்தரவிட்டது.இதனடிப்படையில் கோவை பாரதியார் பல்கலை, 2012 ஆக.,10 ல் மாநில தகுதித் தேர்வு (செட்) அறிவிப்பு வெளியிட்டது. தேர்வு முடிவு 2013 பிப்.,9 ல் வெளியானது. 'நெட்' தேர்வு முடிவு யு.ஜி.சி., இணையதளத்தில் 2012 செப்டம்பரில் வெளியானது.தேர்வு முடிவுகள் வெளியாவதற்கு முன் அனைத்து தாள்களிலும் பொதுப்பிரிவினர் 65 சதவீதம், இதர பிற்பட்டோர் 60 சதவீதம், ஆதிதிராவிடர் மற்றும் பழங்குடியினர் 55 சதவீதம் மதிப்பெண் பெற்றிருந்தால் மட்டுமே தேர்ச்சி பெற்றதாக கருத முடியும் என 'கட்-ஆப்' நிர்ணயித்து யு.ஜி.சி., அறிவிப்பு வெளியிட்டது.
இது சட்டவிரோதம்.ஏற்கனவே குறைந்த பட்ச மதிப்பெண்ணை நிர்ணயித்து, அறிவிப்பு வெளியிட்டுள்ள நிலையில், தேர்வு முடிவுகள் வெளிவருவதற்கு முன், தேர்ச்சிக்கான 'கட்-ஆப்' மதிப்பெண் சதவீதத்தை நிர்ணயித்தது சரியல்ல. முதலில் அறிவித்தபடி, எங்களை தேர்ச்சி பெற்றவர்களாக அறிவிக்க உத்தரவிட வேண்டும். இவ்வாறு குறிப்பிட்டனர்.
நீதிபதி: யு.ஜி.சி.,முதலில் 2012 ஜூன் 4 மற்றும் பாரதியார் பல்கலை 2012 ஆக.,10 ல் அறிவித்தபடி குறைந்தபட்ச மதிப்பெண் பெற்றவர்களை, தேர்ச்சியடைந்தவர்களாக அறிவிக்க வேண்டும். அவர்களுக்கு பல்கலை சான்றிதழ்களை வழங்க வேண்டும் என்றார்.கோவை பாரதியார் பல்கலை 'செட்' செயலாளர் தாக்கல் செய்த மேல்முறையீட்டு மனு:தகுதித் தேர்வில், பங்கேற்பதற்கான தகுதிகளை யு.ஜி.சி.,நிர்ணயித்துள்ளது.
தேர்வு நடத்தும் குழுவில் துணைவேந்தர்கள், கல்வியாளர்கள், மாநில அரசு பிரதிநிதி இடம்பெற்றுள்ளனர். அவர்களின் வழிகாட்டுதல்படி தேர்வு நடந்துள்ளது. இதில், கோர்ட் தலையிட முடியாது. தனி நீதிபதியின் உத்தரவை ரத்து செய்ய வேண்டும். இவ்வாறு குறிப்பிட்டார்.நீதிபதிகள் சதீஷ் கே.அக்னிகோத்ரி, ஆர்.சுதாகர் கொண்ட பெஞ்ச் உத்தரவு: 'நெட்' தேர்வுக்கு 'கட்-ஆப்'நிர்ணயித்தது சரிதான் என, சுப்ரீம் கோர்ட் உத்தரவிட்டுள்ளது. 'செட்'டிற்கு 'கட்-ஆப்' நிர்ணயித்தது பற்றி, சுப்ரீம் கோர்ட் உத்தரவிடவில்லை. மனு தள்ளுபடி செய்யப்படுகிறது என்றனர்.
